Army has a mature layering of surveillance and reconnaissance UASs from micro through to large. However, UAS that can supplement / undertake routine resupply, high risk combat resupply and casualty evacuation missions to troops in contact remains a capability gap. For context, industry could consider Army’s Robotic and Autonomous Systems Strategy which outlines the need for un-crewed and autonomous platforms to deliver combat supplies through self-cueing resupply and automated platform delivery.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">This Challenge Statement is focused on addressing Army’s LOG-UAS needs and is seeking a minimum of Technology Readiness Level (TRL) 3-4 systems. Defence is seeking Submissions that will include a technology demonstration of at least TRL 5 for Australian Army user evaluation within 18 months of contract commencement.</span></p> <span style="line-height:normal"><font color="#70ad47"><b>Overview</b></font></span> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal"><span style="color:#222222">This Call for Submissions (CFS) comprises this Challenge Statement, the Terms and the Evaluation Criteria and Process. This CFS is Stage 1 of a two stage procurement process. Defence wishes to provide industry with an opportunity to hear about this Special Notice at the<i>'RPAS in the Australian Skies 2022'</i> <b>(RPAS22)</b> conference which will be held in Canberra from 29-30 March 2022. Any enquiries or questions about this CFS should be submitted to the email address (<a href="mailto:army.innovation.day@defence.gov.au">army.innovation.day@defence.gov.au</a>), questions and answers will be uploaded onto the DIH Web Portal.</span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal"><b>Stage 1 – Call for Submission</b></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">It is open to Tenderers registered in Australia or New Zealand only. Defence’s objective in this CFS (Stage 1) is to evaluate and then down-select a number of Tenderers to attend Army Innovation Day 2022 (AID22) and to further down-select a number of Tenderers to submit a Request for Proposal (RFP) for Stage 2. CFS (Stage 1) includes:</span></p> <ul style="color:#000000; margin-left:12.0pt; font-weight: normal; font-size:10.5pt; list-style-type: disc; font-family:calibri,sans-serif;"> <li>Completion and Submission of the CFS form (mandatory); and</li> <li>Exhibition and presentation of your submission at AID22 to be held at the Adelaide Exhibition and Convention Centre (mandatory).</li> </ul> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">Tenderers must submit a response to this CFS using the ‘Special Notice Submission Form’ at <a href="https://www.innovationhub.defence.gov.au/call-for-submissions/">https://www.innovationhub.defence.gov.au/call-for-submissions/</a> by <b>1400h (local time in the Australian Capital Territory) on 05 May 2022 (Closing Time).</b></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal"><b>Stage 2 – Request for Proposal</b></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">Defence’s objective in the RFP is to conduct detailed Evaluation of the Proposals to select a number of Tenderers to enter into an Innovation Contract negotiations with Defence. Proposals <u>must</u> clearly articulate the development activities to be completed and commit to deliver a demonstration of the technology at TRL 5 for Australian Army user evaluations within 18 months from contract commencement.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">If the technology will not be ready at TRL 5 within this timeframe, Tenderers are encouraged not to respond to this CFS. An alternative is to consider a Submission through the DIH Web Portal under the Priority Innovation Notice at the following link: <a href="https://www.innovationhub.defence.gov.au/call-for-submissions/">https://www.innovationhub.defence.gov.au/call-for-submissions/</a>. Submissions submitted through this method at the DIH are less time-constrained than AID22 Submissions.</span></p> <p style="margin-bottom:12.0pt"><span style="line-height:normal"><b><span style="font-size:12.0pt"><span style="color:#70ad47">RPAS in the Australian Skies 2022</span></span></b></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">Defence intends to utilise the RPAS22 conference to facilitate an industry briefing on the AID22 Challenge Statement. The RPAS22 conference will be conducted in Canberra, ACT, on the 29-30 Mar 2022 with detailed timings to be provided. Following this conference, all information provided will be uploaded on the DIH Web Portal for viewing by Tenderers who were not able to attend RPAS22.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt; color:red"><strong><span style="line-height:normal">The RPAS22 Industry Briefing Slides are now available. Click [<a href="/aid22-rpas-slides.pdf" target="_blank">here</a>] to access.</span></strong></p> <p style="margin-bottom:12.0pt"><span style="line-height:normal"><b><span style="font-size:12.0pt"><span style="color:#70ad47">Army Innovation Day 2022</span></span></b></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">AID22 will be held as an event within the Chief of Army’s Symposium on 10 Aug 2022 at the Adelaide Convention Centre for a period of one day. The purpose of AID22 is for Tenderers to exhibit proposed innovation concepts (including formal Submission questioning) to nominated Defence personnel. The Deed of Participation Terms (within these CFS Terms) will govern the Tenderers’ mandatory participation, formal Submission questioning, and exhibition and presentation at AID22.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">AID22 is open to Defence personnel, Defence contractors, invited guests and the media with an exclusion to the general public. Invitations will be extended to the Minister for Defence and the Minister for Defence Industry, Service Chiefs, Defence Group Heads, and senior Australian Defence Force officers responsible for capability development. Optional invitations include Australian Federal Police, Australian Border Force and the Department of Home Affairs senior officers and select foreign nationals.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">Upon invitation to AID22, Tenderers will be required to register to attend the event. Due to COVID-19 distancing constraints, a maximum of two attendees per Submission will only be permitted to attend the AID22 event. These personnel will be required to complete an on-line registration and comply with South Australian vaccination requirements. Once registration is completed, an individual registration ID tag containing a QR code linked to the Submission / allocated exhibition booth will be issued via post. This ID will be required for entry into the AID22 event. Further registration and attendance requirements will be provided to invited Tenderers.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">Non-registered personnel will not be admitted to the AID22 event. If any of the two registered personnel cannot attend and wish their registration to be transferred to an alternative company person, Army is to be notified ASAP for authorisation. The alternative person is to register on-line and seek approval prior to AID22 admission. The operational need for LOG-UAS is the ability to deliver combat and other essential supplies to forces operating in terrain that restricts road based resupply (e.g. Jungle or Mountainous regions) or in high risk threat scenarios such as troops in contact or cut off by enemy activity. The operational need for LOG-UAS is the ability to deliver combat and other essential supplies to forces operating in terrain that restricts road based resupply (e.g. Jungle or Mountainous regions) or in high-risk threat scenarios such as troops in contact or cut off by enemy activity. Desirable range greater than 150 km.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal"><b>Theme 3 - CASEVAC UAS - Medical Evacuation</b></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">The primary need is movement of the casualty out of the Combat Team close combat zone to a Role 1 / Role 2 Forward medical facility located in the Battle Group echelon. Identified casualties for UAS transport will be triaged and loaded by a Combat First Aider. It is expected that this UAS would be pre-positioned at a Casualty Collection Point (CCP) or Role 1 facility as close as practical to the expected close combat zone which can then be rapidly deployed to a landing zone close to the casualty. Industry is not required to consider any specialist medical devices or resuscitation needs for the patient to be incorporated into the UAS.</span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal"><b>Payload Requirements</b></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">The system <u>must</u>:</span></p> <ul style="color:#000000; margin-left:12.0pt; font-weight: normal; font-size:10.5pt; list-style-type: disc; font-family:calibri,sans-serif;"> <li>Lift single casualty with individual and medical equipment (Minimum Payload 200 kg);</li> <li>Be compatible with ADF stretcher (Tallon II and NATO standard) variants;</li> <li>Include payload locking system compatible with ADF stretcher variants;</li> <li>Secure lying casualty;</li> <li>Maintain level flying condition whilst the casualty is embarked; and</li> <li>If not damaged, be capable of a minimum of three return trips from the CCP to the treatment facility without the need for recharging or refuelling.</li> </ul> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal">The system should:</span></p> <ul style="color:#000000; margin-left:12.0pt; font-weight: normal; font-size:10.5pt; list-style-type: disc; font-family:calibri,sans-serif;"> <li>Provide small arms ballistic protection for the casualty;</li> <li>Enable communications between a health provider and the casualty;</li> <li>Enable monitoring of the casualty whilst embarked;</li> <li>Securely store and carry medical stores (non-cold chain);</li> <li>Enable the casualty to be transported with intravenous fluid administers (passive/gravity or pressure infused); and</li> <li>Provide climate control (heat/cool) to casualty carrying compartment.</li> </ul> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal"><b>Weight</b>. Minimum Payload of 200 kg.</span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>Range.</b> Minimum of 60 km return flight mission (take off, transit, land, unload/load, take off, transit, & land) – repeated three times totalling 180 km.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify; font-family:calibri,sans-serif;font-size:10.5pt"><span style="line-height:normal"><b>Common UAS Key Requirements</b></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>System of Systems. </b>Defence is not assuming the UAS will be a single platform capable of delivering these logistics effects, rather Defence is open to industry offering a UAS system, which may consider multiple platforms to deliver these combat resupply needs by the most efficient and effective means.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>Modular. </b>Ideally the system will be modular in design to enable major components to be easily repaired or upgraded.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>All Weather Capable. </b>The primary operating environments will be tropical, riverine, and amphibious. The system should be capable of flying in the rain and fog.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>Day & Night Flight Capable. </b>The UAS <u>must</u> be capable of flying in day, night or low light conditions.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>Autonomous Beyond-Visual-Line-of-Sight (BVLOS). </b>The UAS <u>must</u> be capable of autonomous operation and consider anti-collision capabilities to take-off, fly, and land at a designated point / grid reference. The System should allow for up to two landing point changes post launch.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>Redundancy. </b>The system should be based around redundancy noting the requirement to conduct routine resupply, high risk combat resupply and casualty evacuation missions.</span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify"><span style="line-height:normal; font-family:calibri,sans-serif;font-size:10.5pt"><span style="background:#f8f8f8"><span style="color:#222222"><b>Safety. </b>The system <u>must</u> have an alternative recovery mechanism in the case of major failure to its flight systems and protect the payload from a hard landing. font-family:calibri,sans-serif; font-weight: bold;">Evaluation of Submissions</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>Your Submission will be evaluated in accordance with these Terms, including against the Evaluation Criteria set out in the Evaluation Criteria and Evaluation Process Document, located on the DIH Web Portal under this Special Notice CFS.</li> <li>Defence reserves the right to determine the order in which it evaluates the Submissions it receives in response to this CFS.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Army Innovation Day 2022 event</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>Tenderers which meet the requirements of the Challenge Statement will be invited to attend and participate in AID22. By making a Submission, you acknowledge that you agree to the terms and conditions that govern AID22.</li> <li>Defence will use AID22 to clarify and confirm aspects of your Submission and may take your participation at AID22 into account in the evaluation of your Submission in accordance with the Evaluation Criteria. Formal questions may be asked of you or your staff by Defence evaluators, and/or their advisers during a clarification session. Any questions that Defence asks you at the clarification session will be sent to you for a written response after the AID22 event. Any written response provided will form part of your Submission and be taken into account by Defence in the evaluation of your Submission in accordance with the Evaluation Criteria.</li> <li>By making a Submission, you specifically acknowledge and agree to the following terms in relation to AID22: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>you must complete and execute the draft Deed of Participation as part of your Submission and as a mandatory requirement to attend AID22; and</li> <li>you must not materially alter your proposed innovation from that described in your Submission.</li> </ul> </li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Costs</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>You are responsible for all of your costs associated with this CFS.</li> <li>In accordance with clause 9.1, Defence is not responsible for any costs you incur in relation to any of the following: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>preparing or making a Submission;</li> <li>any costs related to your participation at AID22 as outlined in the Deed of Participation; and</li> <li>any engagements with Defence in relation to your Submission.</li> </ul> </li> <li>In accordance with clause 9.1, Defence is not liable to you for any costs or expenses incurred by you in taking part in this CFS, including without limitation, instances where: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>your Submission is excluded or you are not invited to respond to a RFP;</li> <li>your Submission is put on hold in accordance with clause 12 of these Terms;</li> <li>Defence varies or terminates this CFS or the process;</li> <li>Defence exercises any of its other rights in these Terms;</li> <li>you rely on advice from Defence or any other Commonwealth of Australia entities, including the Office of Defence Industry Support (ODIS), in relation to your Submission; or there are failures or problems involving your infrastructure, browser or internet connectivity; and</li> <li>there are failures or problems involving your infrastructure, browser or internet connectivity.</li> </ul> </li> <li>Specific guidance on allowable and unallowable project costs is located in the Budget Calculator should you progress to Stage 2 RFP.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Who owns your Submission?</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>Defence will own any Submission you make - see clause 10 below. This does not affect the ownership of any intellectual property.</li> </ol> </li> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Confidentiality</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>In accordance with the Commonwealth Procurement Rules (CPRs), Defence will treat your Submission as confidential.</li> <li>Notwithstanding clause 10.1, Defence may use and disclose the information in a Submission in accordance with clauses 10.3 to 10.6.</li> <li>You agree that Defence can use the information in your Submission and any further information you give Defence about your Submission: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>for the purposes of evaluating, shortlisting and selecting any Submission and the preparation and conduct of any procurement process prior to the award of an Innovation Contract. For clarity, this includes determining whether to invite you to make a formal Proposal (through a RFP) to enter into an Innovation Contract for funding and development of the proposed innovation in your Submission;</li> <li>to inform the evaluation of your response to a RFP;</li> <li>to verify the currency, consistency and adequacy of information provided by you under any other procurement process conducted by Defence;</li> <li>for internal management purposes, including to evaluate and review its processes, in order to make improvements in relation to future CFS;</li> <li>as part of any industry engagement activities undertaken by Defence; and</li> <li>in the planning for, and development of, any other procurement process conducted by Defence.</li> </ul> </li> <li>You agree that Defence may disclose or provide access to information included in your Submission to: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>authorised personnel within Defence, including contractors and advisers, or third parties for the purposes of assisting Defence in the conduct of the procurement process for the purposes contained in clause 10.3. The Commonwealth may obtain appropriate confidentiality undertakings from any third party prior to disclosure;</li> <li>upon obtaining any appropriate confidentiality undertakings, other government agencies, including state and territory government agencies, to: <ul style="list-style-type: lower-roman; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>consult with them about any information you have provided in your Submission; and/or</li> <li>achieve broader inter-governmental objectives in order to ensure alignment and coordination, including for other government agencies to conduct analysis of the market;</li> </ul> </li> <li>take appropriate action if any statement made in your Submission is incorrect, incomplete, false or misleading, including using the information contained in the Submission for a fraud investigation that would be consistent with the Australian Government’s Investigations Standard and Fraud Control Guidelines.</li> </ul> </li> <li>You acknowledge that as a Commonwealth agency, Defence is subject to legislative and administrative accountability and transparency requirements of the Commonwealth, including disclosures to Ministers and other Government representatives, Parliament and its Committees and the publication of information in respect of the CFS process. Any Innovation Contract resulting from this CFS will also be subject to these requirements, including that contractual provisions (and related matters) may be disclosed to Ministers, other Government representatives, Parliament and its Committees.</li> <li>You acknowledge that you are aware of the impact of the <em>Auditor-General Act 1997</em> on your participation in this CFS and any subsequent Innovation Contract.</li> <li>Defence will not use or disclose information in your Submission other than as set out in clauses 10.3 to 10.6 unless: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>you agree;</li> <li>the information is in the public domain otherwise than due to a breach of confidence;</li> <li>to comply with legal obligations or statutory or portfolio duties, or for public accountability reasons;</li> <li>the information is used or disclosed for the purposes of Defence ensuring and promoting compliance with Defence security policy, export controls and relevant protective security requirements; or</li> <li>to defend any claim made in relation to the process or a procurement by Defence (whether or not of the innovation proposed in your Submission).</li> </ul> </li> <li>Privacy <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>You agree that Defence may collect, store, use and disclose the personal information provided in your Submission for the purposes of evaluating your Submission and for other purposes relating to the administration of this process, the RFP stage and or in relation to 10.3.</li> <li>You may choose not to provide personal information but in this case Defence may not be able to evaluate your Submission.</li> <li style="text-align: left;">The Defence Privacy Policy, which contains information regarding how Defence collects, stores and uses personal information, is available at <a href="http://www.defence.gov.au/privacy.asp"> http://www.defence.gov.au/privacy.asp</a>.</li> </ul> </li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Your acknowledgments and agreements</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>By making a Submission you: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>acknowledge that you do so, and participate in the process (including any potential attendance at AID22), at your own risk and cost;</li> <li>acknowledge that Defence is not obliged to proceed further with any Submission you make, or enter into arrangements with you about the innovation proposed in your Submission;</li> <li>acknowledge that if your Submission is progressed, you will need to comply with RFP Terms issued by Defence;</li> <li>acknowledge that, subject to these Terms, Defence may deal with other organisations (whether or not they have made a Submission) in relation to proposed innovations that may have Defence applications;</li> <li>acknowledge that in evaluating Submissions, Defence may consider additional information related to any Evaluation Criteria (including information obtained from sources other than you);</li> <li>declare that the information provided in the Submission is accurate, complete and current and acknowledge that giving false or misleading information is a serious offence under the <em>Criminal Code Act 1995;</em></li> <li>declare that you have not – and your related bodies corporate (as defined in the <em>Corporations Act 2001</em>), as well as officers, employees, agents and advisors of you or your related bodies corporate, have not – broken any applicable law (including foreign laws) about offering of inducements in connection with the preparation of your Submission; and</li> <li>declare that all actual, potential or perceived conflict between Defence’s interests and your interests in relation to the process (if any), have been identified in your Submission, and that you will immediately notify Defence if you become aware of any actual, potential or perceived conflict between Defence’s interests and your interests in relation to the process. "Your interests" includes the interests of your related bodies corporate, and the interests of the officers or employees of you or your related bodies corporate.</li> </ul> </li> <li>By making a Submission which names you as the lead Tenderer and other entities as project partners, in addition to your acknowledgements and declarations in clause 11.1, you acknowledge and declare that: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>each of the project partners make the acknowledgements and declarations referred to in clause 11.1; and</li> <li>you have the authority to provide the acknowledgements and declarations on behalf of each of the project partners.</li> </ul> </li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Exclusion</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>Defence may, at any time, exclude a Submission from further consideration if: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>clause 2, clause 4, clause 5 or clause 12 of these Terms is breached; </li><li>the evaluation of the Submission against any one or more Evaluation Criteria or value for money considerations suggests that there is no reasonable prospect of the proposed innovation being progressed by Defence;</li> <li>Defence considers that the technology may present high risk to the environment, safety, security, persons or property or may breach the law or infringe the rights of others;</li> <li>Defence considers the Submission includes a false, misleading or deceptive claim or statement;</li> <li>if any of the circumstances specified in clauses 3.2a or 3.2b or 3.2c applies to the Tenderer;</li> <li>Defence considers that there is a more appropriate program or source of funding for the proposed innovation;</li> <li>the proposed innovation has been developed by or with the assistance of an individual during the course of their employment with Defence;</li> <li>the Submission has been complied using information unlawfully obtained from the Commonwealth (including in breach of an obligation of confidentiality owed to the Commonwealth);</li> <li>the proposed innovation is covered by existing procurement activities Defence is undertaking;</li> <li>the proposed innovation has been developed under a contract with Defence (unless the contract specifically allows the submission to be made); </li> <li>the Submission includes information that cannot be read or decrypted, or Defence believes the Submission may contain a virus, malicious code or anything else which may compromise the integrity or security of its ICT environment;</li> <li>minimum content and format requirements in clauses 2.2 and 2.3 have not been met;</li> <li>the Submission or a part of the Submission is lodged after the Closing Time, as specified in clause 2.1;</li> <li>the Submission is incomplete;</li> <li>the Submission does not include all the information requested as part of this CFS; or</li> <li>the proposed innovation submitted is evaluated to be at Technical Readiness Level 9 or a Commercial-Off-The-Shelf solution without consideration of a development pathway to meet ADF contexts, as specified in the Challenge Statement;</li> <li>when invited to attend and participate in AID22 by Defence: <ul style="list-style-type: lower-roman; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>you have failed to execute a Deed of Participation as required under clause 1.3; or</li> <li>you have provided Defence with an executed Deed of Participation that has amended terms (other than to complete the details required by the deed for execution).</li> </ul> </li> </ul> </li> <li>Should any of 13.1 apply to a Tenderer, Defence may consider the Submission as unsuccessful.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Putting a Submission on hold</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>Where, due to balance of investment considerations, Defence has evaluated that a Submission is suitable to progress, but cannot currently be invited to progress to RFP, Defence may put that Submission on hold.</li> <li>If a Submission is put on hold in accordance with this clause, Defence will advise the Tenderer accordingly, and will contact the Tenderer to discuss how the Submission may be progressed.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Withdrawing a Submission</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>You agree that your Submission is valid unless or until it is withdrawn.</li> <li>You may withdraw a Submission at any time by submitting an <a href="http://www.innovationhub.defence.gov.au/enquiry/">online enquiry</a> form via the Innovation Hub Dashboard.</li> <li>If you withdraw a Submission before Defence has evaluated it, or during its evaluation, Defence will cease any further evaluation.</li> <li>If you withdraw a Submission that has been put on hold, Defence will not progress that Submission further.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Debriefing</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>You will be notified whether your Submission has been successful or unsuccessful. You may request an oral or written debrief from Defence in relation to a successful or unsuccessful Submission.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Complaints</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>In the event you wish to lodge a formal complaint regarding this process, the complaint is to be directed in writing to:<a href="mailto:procurement.complaints@defence.gov.au">procurement.complaints@defence.gov.au</a>. Tenderers must cooperate with Defence in the resolution of any complaint regarding the process.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Security requirements</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>You must not include security classified material (Australian, foreign or proprietary) in your Submission. If there is a concern that your Submission would not be able to adequately convey the innovation and its benefits to Defence without including more sensitive or potentially classified information, the Tenderer is to contact the Defence Innovation Hub and make arrangements to provide the additional information using appropriate security protocols prior to the Submission of your CFS. Submissions containing classified information are to be prepared and transmitted as follows: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>for Australian Submissions, in accordance with Principle 71 of the Defence Security Principles Framework (DSPF) as amended from time to time; or</li> <li>for overseas Submissions, in accordance with the applicable industry security information system regulations issued by the appropriate government security authority in their country. If transmission involves transmission by diplomatic bag, the overseas Tenderer is to use the diplomatic bag of its own government.</li> </ul> </li> <li>If only part of a Submission contains classified information, that part must be segregated from the remainder of the Submission for separate transmission prior to the Submission of your CFS. </li> <li>If required and on request by Defence, the Tenderer is to comply with the Commonwealth security clearance and accreditation process as detailed in Principles 40, 72 and 73 of the DSPF as amended from time to time, including obtaining the level of security clearance and accreditation required by the Commonwealth.</li> </ol> </li> <br> <li><span class="tablegroup" style="color:#65B32E; font-family:calibri,sans-serif; font-weight: bold;">Interpretation of these Terms</span> <ol style="color:#000000; font-weight: normal; font-size:10.5pt; font-family:calibri,sans-serif;"> <li>In these Terms, unless the contrary appears: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>the singular includes the plural and vice-versa;</li> <li>a reference to one gender includes the others;</li> <li>"AID22" means Army Innovation Day 2022;</li> <li>"Call for Submission or CFS” means the terms notified to the market that govern the first stage CFS process for this Special Notice;</li> <li>"Challenge Statement” means the cover document to these Terms that sets out the challenge statement for this Special Notice;</li> <li>"Closing Time" means the time and date specified as such in the Challenge Statement;</li> <li>"Contract Phase Statement” means the document included in the Innovation Contract entitled Contract Phase Statement</li> <li>"Defence" refers to the Commonwealth of Australia as represented by the Department of Defence, including its advisers or contractors;</li> <li style="text-align: left;">"DIH Web Portal" means the webpage available at <a href="https://www.innovationhub.defence.gov.au/call-for-submissions/">https://www.innovationhub.defence.gov.au/call-for-submissions/</a>;</li> <li>"DIH Dashboard" means the page visible to users of the DIH Web Portal after login;</li> <li>"Evaluation Criteria" means the evaluation criteria described in the Evaluation Criteria and Process Document.</li> <li>"Evaluation Criteria and Process Document” means the document which contains the evaluation criteria and process for this Special Notice published by Defence on the DIH Web Portal;</li> <li>"Evaluation Process" means the process described in the Evaluation Criteria and Process Document.</li> <li>"Innovation Contract" means a contract between Defence and a Tenderer, formed after the Tenderer has provided a successful response to a RFP;</li> <li>"Request for Proposal" or "RFP" means the second stage request for Proposal process for this Special Notice;</li> <li>"Special Notice" means a two-stage or single stage procurement process issued by Defence under the DIH program to address a specific problem or technical challenge;</li> <li>"Standard Terms" means the document entitled "Innovation Contract – Standard Terms";</li> <li style="text-align: left;">"Statement of Tax Record" means a statement of tax record issued by the Australian Taxation Office following an application made in accordance with the process set out at <a href="https://www.ato.gov.au/Business/Bus/Statement-of-tax-record/?page=1#Requesting_an_STR">https://www.ato.gov.au/Business/Bus/Statement-of-tax-record/?page=1#Requesting_an_STR</a>;</li> <li>"Terms" means these terms for the CFS, and includes the Evaluation Criteria and Process; and</li> <li>"the process” refers to the procurement process commenced by this CFS.</li> </ul> </li> <li>To the extent of any inconsistency, these Terms take precedence over: <ul style="list-style-type: lower-alpha; font-family:calibri,sans-serif; font-size:10.5pt;"> <li>information set out in the Challenge Statement, or on relevant Commonwealth websites including <a href="http://www.business.gov.au">business.gov.au</a>, AusTender or on the Defence Industry & Innovation social media platforms;</li> <li>instructions or guidance within the “AID22 Special Notice Submission Form” for this Special Notice; and</li> <li>any other guidance documents on completing the “ AID22 Special Notice Submission Form” for this Special Notice.</li> </ul> </li> </ol> </li> </ol> </div>

Defence will also provide a draft Innovation Contract for Tenderers to complete the draft Contract Phase Statement, draft Project Execution Plan and relevant Annexes (e.g. the IP and Technical Data Schedules). <strong>Defence will not negotiate the Standard Terms of the Innovation Contract. Tenderers who are invited to attend AID22 will have the opportunity to engage with one another during the conduct of this event.</span><br> <br></span> <span style="tab-stops:center 233.95pt"><span style="font-size:10.0pt"><strong>Question 19</strong>: When referring to Dangerous Goods in the Challenge Statement, what does Classes 3 and 5 encompass?<br> <strong>Answer</strong>: The Class refers to the Military Classes of Supplies as defined in Australian Army Doctrine which aligns with the US and NATO Classes of Supplies. We have identified the three critical classes of supplies for supporting tactical logistic resupply in accordance with the Challenge Statement. The Definition of the classes of supply are:</span><br> <ul style="color:#000000; margin-left:12.0pt; font-weight: normal; font-size:10.0pt; list-style-type: disc;"> <li>Class 1 - Subsistence items such as foodstuffs, combat rations, packaged water, water purification tablets, hexamine tablets, stoves, foot powder, mosquito repellent and ecclesiastical support stores.</li> <li>Class 3 – Petroleum, oil and lubricants (POL) including aviation, marine and ground fuels, LPG, hexamine, and associated oils and lubricants.</li> <li>Class 5 - Ammunition of all hazard classes including mortars and pyrotechnics.</li> </ul> <br></span> <span style="tab-stops:center 233.95pt"><span style="font-size:10.0pt"><strong>Question 20</strong>: What number of landing sites will be available at, the Combat Team, the Battle Group Support and the Brigade Support areas?<br> <strong>Answer</strong>: Army has yet to determine how the LOG-UAS will operate within the above organisations and therefore cannot provide further detail on the quantity of landing sites. Current refuelling facilities and practices should not constrain the development of potential LOG-UAS in accordance with the Challenge Statement.</span><br> <br></span> <span style="tab-stops:center 233.95pt"><span style="font-size:10.0pt"><strong>Question 22</strong>: What are the Army unloading procedures for a Combat Team area?<br> <strong>Answer</strong>: The Combat Team will have organic logistics vehicles and material handling equipment. This would enable the loading and unloading of the current fleet of medium and heavy logistic vehicles in the field environment. The LOG-UAS System should be transported into the area of operations using in service vehicles, trailers or container solutions. The system should seek to utilise as little container / vehicle space as possible to ensure deployment with current transport assets.</span><br> <br></span> <span style="tab-stops:center 233.95pt"><span style="font-size:10.0pt"><strong>Question 23</strong>: Is it possible to review the Tactical Logistics Uncrewed Aerial System brief prior to committing to the Army Innovation Day in August?<br> <strong>Answer</strong>: Defence’s objective in Stage 1, CFS is to evaluate and down-select a number of Tenderers to attend AID22 and then further down-select a number of Tenderers to submit a RFP for Stage 2. Further information regarding Army Innovation Day will be provided to invited Tenderers.
